1. Acceptance of Terms

By accessing and using KittyDiary, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service are in addition to any other agreements you may have with Apple Inc. regarding the App Store. Your use of the app must comply with Apple's App Store Review Guidelines.

2. Use License

Permission is granted to temporarily download one copy of the app per device for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to reverse engineer any software contained in the app
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You may delete your account at any time by contacting us at notify@seawallsoftware.ca. Upon account deletion, we will remove your personal data within 30 days, except where required by law.

4. Age Requirements

This app is intended for users 17 years of age and older. By using this service, you represent and warrant that you are at least 17 years old.

If you are under 18, you may need parental consent to use this service. We reserve the right to verify your age and may require additional verification if necessary.

Users under 17 are not permitted to use this service. If we become aware that a user is under 17, we will terminate their account and delete their data.

5. User Conduct

You agree not to use the service to:

• Post any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity
• Interfere with or disrupt the service
• Collect or store personal data about other users without their consent
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to the service or its systems
• Post spam, promotional content, or commercial advertisements
• Use excessive capitalization or repetitive characters to circumvent content filters

5.1 Content Moderation

We implement automated content filtering to maintain a safe environment. All user-generated content is screened before publication for:
• Inappropriate language and profanity
• Hate speech and discriminatory content
• Violence and threatening language
• Spam and promotional content
• Excessive capitalization and repetitive characters

Content that violates these guidelines will be automatically rejected or removed. Users may also report inappropriate content for manual review.

6. Content Ownership

You retain ownership of any content you submit, post, or display on or through the service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content for the purpose of providing the service.

You are responsible for ensuring you have the right to share any content you post, including images and other media.

7. Privacy

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, governs how we collect, use, and protect your information. By using the service, you consent to the collection and use of information as described in our Privacy Policy.

8. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

You may terminate your account at any time by contacting us at notify@seawallsoftware.ca. Upon termination, your right to use the service will cease immediately.

9. Limitation of Liability

In no event shall KittyDiary, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

Our total liability to you for any claims arising from your use of the service shall not exceed the amount you paid, if any, for the service in the twelve months preceding the claim.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. We will notify you of material changes through the app or by email.

Your continued use of the service after any changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be resolved in the courts of Canada.
